The program has proven successful. 00:09:22
At other darks throughout Georgia and the DNR believes our location will serve. 00:09:25
As a great addition to these efforts. 00:09:29
They will be providing additional information soon. 00:09:31
Posting on our website. No assistance or permits are required from the city. 00:09:36
As the lease agreement for the dock allows for these types. 00:09:40
Collection programs. 00:09:43
So when they you go down to put your boat in at the meeting states Meeting St. boat ramp. 00:09:45

Mr. Mayor, that concludes my report for sooner. 00:09:57
Unless someone has a question. 00:10:00
Will this agreement with DNR for the oyster shells? 00:10:02
Have any language in there about how often they will? 00:10:07
Collecting empty those things. That's to prohibit them from becoming. 00:10:10
I want to risk. 00:10:14
Owners. 00:10:17

Two things. 00:13:43
The item. 00:13:44

Or compliance or the service contract. 00:13:52
You know. 00:13:55
I know y'all won't send it out. 00:13:57
And like this is, we only had one. 00:13:58
And I'm kind of wondering you. 00:14:02
Where is, by the way, 6600. 00:14:05
Aberdeen. 00:14:07
Street sweet toner. Is that in Saint Marys? 00:14:10
In Savannah, I believe. 00:14:12
Oh. 00:14:14
Savannah. 00:14:16
OK. 00:14:17
So Mr. Blunt and all you guys ain't taking a chance, ain't going for it. 00:14:19
They don't do audit services like this very specialized field. 00:14:23
All the same was sweet 200, so I didn't know where it was, you know, I mean, all right. 00:14:29
I want to go back to. 00:14:35
Scrubby Bluff. 00:14:41
You know. 00:14:44
You know, uh. 00:14:45
When we get to. 00:14:47
When I'm trying to think of where. 00:14:50
That whole area, the shell BPKOA map. 00:14:52
Those are come up. 00:14:56
That comes up under scenarios. 00:14:58
City of Saint Mary's. 00:15:01
I think most of the properties on the West side of the Interstate are city of Kingsland. 00:15:03
On Well, there's a little piece there. Let's see what it. 00:15:09
Science starts OK, for example. 00:15:11
Where the pilot is PIL. 00:15:13
The street The street itself does go down to Saint Mary's. 00:15:15
And I think there's a piece of there's a parcel down there somewhere that's flagged in. 00:15:18
But most of. 00:15:22
What's on the West Side? 00:15:23
Is insidious king. 00:15:25
Even the pilot. 00:15:27
The pilot feasted on our side is. 00:15:29
Well, there's a pilot. Pilot on the east side is Saint Mary's. Pilot on the West side is Kings. And I'm pretty sure, yes, yes. 00:15:33
Also, everything on that side is. 00:15:40
Basically. 00:15:42
Kingsland. 00:15:44
But they put a. 00:15:45
Yeah, that sign up there showing a way back. 00:15:46
The koe and all that stuff, all that the beat the BP and shell. 00:15:49
All that belongs to Kingston. 00:15:53
Wow, I didn't know that. 00:15:54
OK, that says a lot then. 00:16:00
You know that, Kiwi? 00:16:03
Coach parking and all that stuff. Or less Kingsland. 00:16:04
Oh, I didn't know that. 00:16:09
I thought I was 5 Saint Mary's. 00:16:11
We understand my video, that's why. 00:16:15
Thank you, Sir. 00:16:17
Thank you, Bert. 00:16:18
Honey White, 102 Sylvia. 00:16:37
I'm glad to see that you're concerning. 00:16:41
Item A under new business. 00:16:43
Which is not to renew the. 00:16:45
The contract with this company. 00:16:47
That's been used in the city of Saint Mary's. 00:16:49
Emblem. 00:16:52
Under envelopes, milling out advertisements. 00:16:53
The property owners. 00:16:55
Thinking that it's dealing with us. 00:16:57
With the consent of the. 00:16:59
Saint Mary's government. 00:17:01
And I read through your. 00:17:03
And I don't think they have a leg to stand on when you don't remove. 00:17:04
We know our our. 00:17:08
Contracts with them, I think that probably is up in February, I think. 00:17:10
You have to do a 90 day. 00:17:14
Notification that you're not going to redo the contract with them. 00:17:15
So I hope that's true. 00:17:19
The other thing is on item I. 00:17:22
I'm not sure exactly what that means. 00:17:25
And since I was just. 00:17:27
Today. 00:17:29
To the to the agenda, I would like a better exclamation from. 00:17:30
Councilwoman Keene as to why. 00:17:35
She wants to rescind us. 00:17:38
Agreement with the county. 00:17:39
We'll do that when we discuss it. 00:17:42
Dave Schmidt's 112 new Hammock Circle up in shadow on. 00:17:53
Just wanted to remind everybody that the 25th. 00:17:59
Of October Saturday. 00:18:02
Is, I believe, the 10th annual. 00:18:04
Alzheimer's walked for. 00:18:07
Camden County. 00:18:09
Thank you. 00:18:12
Start start to have the water from. 00:18:14
And then ends at the waterfront park. 00:18:18
All right, there's no one else we'll forget. 00:18:30
OK, I'm sorry, no. 00:18:33
Have a question? 00:18:34
Have a question? Jamie Galvez, 1007 McDowell. 00:18:37
Saint Mary's. 00:18:41
McGowan St. 00:18:42
Rezoning of the industrial. 00:18:44
Park. 00:18:46
When will that come on the agenda? 00:18:47
Or does it have to go through the next meeting? 00:18:50
Yeah, it's already been. It's already been done. 00:18:53
Yeah. So, yeah, we so. 00:18:55
That's right. So the. 00:18:58
You tell them that the commerce park or the industrial park? Industrial park with little airports at. 00:18:59
But yeah, the same Thomas part we do. We did that at the last meeting. 00:19:05
Sorry fast. Sorry fast. 00:19:09
Yes, Sir. 00:19:11
Could you please repeat your name? 00:19:12
An address for the clerk. 00:19:14
Jaime for statement. Nobody ever spelled it. 00:19:16
Galvez. Same thing. GALAVIZ. 00:19:20
1007 McDowell Street, Saint Mary's. 00:19:24
Thank you. Second. 00:19:27
OK. Thank you very much. 00:19:29
All right, there's someone else Will. 00:19:39
Vote on our consent agenda. So once again to. 00:19:42
We have items. 00:19:48
ABC. 00:19:51
FG and H on our consent agenda. I have a motion to approve. 00:19:54
So moved. 00:19:57
2nd. 00:19:59
And motion by. 00:20:01
I'm seeing him a second by Mr. Jones. 00:20:02
Any discussion? 00:20:04
All those in favor. 00:20:06
Aye. 00:20:07
Any opposed? 00:20:09
OK. That's unanimous. 00:20:10
Yes, Sir. 00:20:11
And now have a motion to approve the agenda. 00:20:12
From the Miss Keene. 00:20:16
Any other? 00:20:19
Questions or comments? All those in favor, aye? 00:20:20
Aye, any post. 00:20:23
Yes, Sir. 00:20:26
OK. So that takes us into our new business and. 00:20:28
I do want to comment, Mr. White, you brought it up on Item A. 00:20:31
Just so everyone knows. 00:20:36
Like you said that. 00:20:38
We're moving forward with the steps to cancel that, but. 00:20:40
The contract goes on until early next year, February, March and so. 00:20:44
You may still yet receive letters. 00:20:48
But the process is underway. 00:20:51
OK. And with that we've got item. 00:20:53
D The National Flood Insurance Program Community rating. 00:20:57
Miss Stein is going to address. 00:21:00
Thank you, Council members and Mayor, and thank you, Madam Clerk, for. 00:21:05
Queuing up this presentation. 00:21:10
So about this time every year, the Community Development Department. 00:21:12
Issues what's called the Program for Public Information report. 00:21:17
This has to do with our participation in the Community rating system, which is part of the National Flood Insurance Program. 00:21:23
So in the report that you've received, I just wanted to go over. 00:21:30
A few key items. 00:21:33
I also wanted to let you know that. 00:21:35
Typically we do an annual recertification of this program. 00:21:37
But on. 00:21:43
September 1st I did receive an e-mail. 00:21:45
In which FEMA has announced that the CRS program. 00:21:49
Will no longer be. 00:21:54
Have a recertification review. 00:21:56
So typically by October 15th my office has to send. 00:22:00
All the information in. 00:22:04
To kind of an auditor. 00:22:06
And they look at all of the work that we've done over the year. 00:22:08
And they give us. 00:22:11
Recertification of our levels of participation in the program. 00:22:14
This year, due to a reduction in funding, they won't be doing it, but they just ask that we continue to operate business as usual. 00:22:19
So that's what we're going to continue doing. 00:22:24
So the program for public information, this is a report that is tipped. 00:22:29
Typically the same every year. 00:22:34
But I did. 00:22:36
Highlight a few key things for members of the public. 00:22:38
So our website, on the Community Development Department's website, there is a section on floodplain management. There are several 00:22:42
great resources in there, particularly related to knowing your flood zone, the city's flood map. 00:22:48
Different resources for flood protection. 00:22:56
We also have repetitive loss mailing, so every year my department will send letters. 00:23:00
To those properties which have experienced repetitive losses due to flooding. 00:23:06
We also for any of you that are in the floodplain. 00:23:11
Probably received a brochure from us that looks something like this. 00:23:16
So that's part of our annual communications. 00:23:20
And we also do public announcements. I did one at the. 00:23:23
Work session. 00:23:26
Or the development progress? 00:23:28
Last week and we're doing it again here. 00:23:31
A couple of new exciting things, though. 00:23:33
Under the leadership of the county's floodplain manager, a woman named Miss. 00:23:35
Tassie Turpin. 00:23:41
She has reengaged A countrywide group. 00:23:43
Of stakeholders that will meet on a quarterly basis. 00:23:47
To review our program for public information. 00:23:51
And see if we can come up with some creative ways. 00:23:54
To get more information out there and more participation. 00:23:56
And a great thing about that is that she's engaged the city of Kingsland, which is new to this year's program. 00:24:00
She's also engaged someone from the real estate sector. 00:24:06
As well as someone from the home insurance sector. So we look forward to continuing those quarterly meetings. 00:24:10
In future. 00:24:16
And one little tidbit of. 00:24:18
Of data. 00:24:21
Every year starting we stopped counting October 1st, so October to October. 00:24:22
We tally all of the certificates of occupancy that have been issued for new structures in the floodplain. 00:24:29
And this last year we CEO 36 new structures in the floodplain. 00:24:35
Any questions? 00:24:41
I I do have a question. 00:24:42
This is great and I love to hear that there's going to be some. 00:24:45
Meetings about public information. 00:24:49
Will we be getting out any information for people that may be building or remodeling in a floodplain so that they're very aware of 00:24:53
certain? 00:24:58
Special code requirements. 00:25:04
In a floodplain. 00:25:07
Yes, so typically. 00:25:09
When there is a. 00:25:12
Property they get takes out a building permit. 00:25:14
Most building permits that do anything on the exterior or create something new will require a site plan. 00:25:17
My office and I will check to see if it is in the special flood hazard area. If it is, then they have to get an elevation 00:25:24
certificate and they have to go through a series of steps. 00:25:29
I mean, if anyone's thinking about remodeling or building in the floodplain, please come see me. You know, anybody I pride myself 00:25:34
on. 00:25:38
Anybody can walk into building and planning and get somebody from 8:00 AM to 5:00 PM. 00:25:42
Even juggling lunch hours. So please just come in and talk to us if you have. 00:25:47
Any any questions about that and I think. 00:25:51
The remodeling piece which we've. 00:25:54
Had a little bit of trepidation with in the past. 00:25:56
There is a substantial improvement clause. 00:25:59
In the National Flood Insurance Program. 00:26:03
And in our floodplain management ordinance? 00:26:05
So just please be reminded. 00:26:08
If you are if you are doing renovations which constitute more than 50%. 00:26:10
Of your existing property value. 00:26:15
I'll be asking you for your elevation surgery. 00:26:18
That's great. Thank you, Jamie. 00:26:22
Thank you very much the motion. 00:26:24
Yes, Sir. 00:26:29
She said so moved to outside. 00:26:30
Jumped on any further questions. 00:26:33
All those in favor, aye. Any opposed? 00:26:37
Unanimously, Madam Sir. 00:26:41
All right. 00:26:45
Next item then is the professional services contract for Geographic Information Systems with. 00:26:47
The CRC. 00:26:53
Thank you. 00:26:55
My question is simple, you know it's just a. 00:26:57
Probably yes or no. 00:27:00
Do we have anybody in house? 00:27:06
It has a. 00:27:09
Knowledge. 00:27:12
Or did we have anybody at one time? 00:27:15
Yes and yes. 00:27:20
So I'll, I'll speak to that. 00:27:21
We used to during my time here, we did umm. 00:27:24
Advance a role in the department for a GIS Manager. 00:27:29
That particular employee didn't. 00:27:35
Workout. Umm. 00:27:37
And. 00:27:39
Because I've learned. 00:27:40
Basically are the extent. 00:27:43
Of how much geographic information system work that we do on the city. 00:27:46
I don't feel that that role is necessary anymore. 00:27:50
One of the things that when? 00:27:53
I came into the role we had. 00:27:55
An enterprise server, which is something in the GIS world that the county has. It's a very large investment. 00:27:58
In doing GIS and frankly. 00:28:04
We don't, we don't do that type of analysis and layered creation and. 00:28:06
Those types of things that would warrant that investment or having a GIS manager. 00:28:12
So we paired it down and now we. 00:28:17
Do this professional services contract with the Coastal Regional Commission? 00:28:20
We had this in place last year, so this is just a renewal. 00:28:24
Some of the great things that came out of this professional services contract. 00:28:29
Was the integration of our. 00:28:33
Zoning map and and parcel layers that we have on the website. 00:28:36
With cloud permit. 00:28:41
Which is our online permitting system. So now those two systems speak to each other. 00:28:42
And that requires. 00:28:46
A bit of a bit of coding that sends the counties. 00:28:48
Data. 00:28:51
To our version of cloud permit and back and that happens on. 00:28:52
Monthly basis. 00:28:56
In house, our junior planner, Miss Elise Pierce is is. 00:28:58
Excellent. Incredible. Potentially one of my best hires. 00:29:05
And she is getting her master's degree. 00:29:08
Front of the University of Florida. 00:29:11
But. 00:29:14
In in city and regional planning and she has really upped our internal GIS game so she. 00:29:17
Make sure that some of the things that that we're doing in house. 00:29:24
Are of really good quality. 00:29:27
So just to kind of clarify, we we have the in-house capability to access the system and pull basic information things we might 00:29:31
need. 00:29:34
But that we are relying on CRC for some of the back end programming and integrations and things like that, that's what this 00:29:39
contract is about. 00:29:42
Yeah, most recently we had to update all of the city streets. 00:29:46
And we worked with CRC to do that, and that actually helped us create new. 00:29:50
Grids of the city streets for after. 00:29:55
Emergency responses. So a couple of real good things. 00:29:59
OK, any other? 00:30:03
I have a motion to approve. 00:30:05
Sunil Jones, is there a second? 00:30:08
Second. Second by Mr. Ingram. Any discussion? 00:30:10
All those in favor. 00:30:14
Aye, any opposed? 00:30:15
Unanimous. Yes, Sir. Thank you, Miss Stein. 00:30:17
And that takes us to. 00:30:24
Item I. 00:30:28
The possibility of resending the resolution and quick claim deed for the transfer of ownership and. 00:30:31
I'll let Miss King start. 00:30:37
The conversation about. 00:30:39
About this. 00:30:41
So. 00:30:42
On September 15th. 00:30:43
The Council. 00:30:46
One of the items that we approved was the transfer of our. 00:30:48
Park. 00:30:52
From. 00:30:53
And this is the park. 00:30:54
That contains the Aquatic Center. It's 40 some plus. 00:30:56
Acres. 00:31:00
From the PSA. 00:31:02
Back to the city of Saint Mary's. 00:31:04
One of the things. 00:31:07
That happened during that meeting was our city attorney mentioned that he had some concerns about that so early this week I spoke 00:31:09
to him about that. 00:31:13
And. 00:31:19
One of the things that I learned during that conversation is that when he was doing the title search. 00:31:20
On the property. 00:31:26
He found an IRS lien. 00:31:29
And as you may remember. 00:31:32
There were some problems in the past way in the past. 00:31:34
With the PSA and their payroll taxes. 00:31:38
So I talked to my fellow council members. There were. 00:31:42
Four of us. 00:31:47
That did not know about. 00:31:49
The IRS wing. 00:31:51
And the other two from various. 00:31:53
Work and conversations that they were doing. 00:31:55
Didn't know about it. 00:31:58
I just wanted to bring that information forth. 00:32:01
Because the lien. 00:32:05
I've got the lanes here. 00:32:08
From the county. 00:32:11
Totals approximately. 00:32:13
1.1 plus or minus some money. 00:32:16
And those lanes? 00:32:21
Transfer with the property. 00:32:22
So. 00:32:25
Could you? You said 1.1. 00:32:26
Plus or minus? Yeah, there's one for. 00:32:30
Yes, we didn't. We didn't hit a million. 00:32:34
Oh, OK. 00:32:37
914,838. 00:32:39
594,309. 00:32:42
And 36,120. 00:32:47
So. 00:32:50
There's really. 00:32:52
I mean, I don't think I would have voted the way I did, right? And this? 00:32:54
By the way, was a consent item. We all knew that we wanted to get this done. We've been working to try and get the parks out of 00:32:57
the PSA and take over maintenance. 00:33:02
So I think at this meeting it was natural that it was a consent item. 00:33:07
Had I known about the lien, I would have at least wanted to discuss it. 00:33:13
Especially with you all. 00:33:18
Make you aware of it. 00:33:20
So there's really no. 00:33:22
Cut and dried answer on this. 00:33:26
No good answer. 00:33:28
Really. 00:33:29
But uh. 00:33:30
There are a couple of options that we have. 00:33:31
I understand from the attorney that the. 00:33:34
One of the things we can do. 00:33:38
Is trying to negotiate something with. 00:33:41
The county and the city. 00:33:44
Of Kingsland, the city of Saint Mary's in the city of Woodbine. 00:33:47
As to their obligation. 00:33:51
Regarding this lane. 00:33:54
And essentially, we would be all. 00:33:57
All of us would be responsible because the PSA really doesn't have any money. It's funded by all of the cities in the county. 00:34:00
So since it's a PSA debt. 00:34:08
It's natural to think. 00:34:14
That we would all pitch in on that, but when you're dealing with the IRS. 00:34:15
You're never sure. Once I have a lien on a piece of property, you know they're. 00:34:23
If they. 00:34:27
Feel like they. 00:34:28
Need to exercise that they can so. 00:34:29
My idea is that we just tap the brakes for a minute here and work out that agreement. 00:34:33
And then? 00:34:41
Transfer the property after that. 00:34:44
And is there any other? 00:34:49
Commentary on that. 00:34:51
Go ahead. 00:34:55
I knew about the. 00:34:58
The issues with. 00:35:00
IRS last year. 00:35:02
And it just. 00:35:04
I never thought that they would put a land on the property. 00:35:06
If we decided that, we would. 00:35:10
Pull out. 00:35:12
Of the PS3. 00:35:14
And it's. 00:35:15
It's unfortunate that. 00:35:17
Once they put a lien on a piece of property, it's. 00:35:19
We have to accept the responsibility of. 00:35:22
Of pavement. So I agree, maybe we need to. 00:35:25
Just kind of. 00:35:30
Slow our roll until we can get a a handle on this and. 00:35:31
Find out who's going to pay what, or if we have to pay anything. 00:35:35
In order to. 00:35:39
Yet the land. 00:35:41
Free and clear. I would like to add one more thing. 00:35:43
Excuse me when our city attorney did. 00:35:47
The title search on the land. 00:35:50
He did find the lien. 00:35:53
And he did talk to our city manager and mayor about that. And you know. 00:35:56
As I pointed out, there are many different ways to look at this. 00:36:01
And I don't know that any particular way is wrong. 00:36:06
Some ways, you know, you could say, well, that's down the road and surely everybody will agree to pitch in when the time comes. 00:36:11
But. 00:36:15
It could be two or three years, maybe even longer, before this gets resolved. 00:36:19
And uh. 00:36:24
You know by their very nature our city government. 00:36:26
Councils change every couple of years, so. 00:36:30
I tend to go with the conservative. 00:36:34
Approach and that is to work that issue out first and then transfer the property. 00:36:37
After that. 00:36:43
Yeah, those are definitely all, uh. 00:36:47
Very valid concerns. 00:36:49
I do know the PSA. 00:36:52
And their board changes as well. 00:36:54
They do have. 00:36:56
You know, a current board that's been. 00:36:57
On top. 00:36:59
Of the situation as far as. 00:37:00
They have made multiple. 00:37:02
Attempts to settle the debt at a reduced amount. 00:37:03
Those have failed but. 00:37:07
This last. 00:37:08
Or where they're at currently is they have hired a law firm that deals with this specifically. 00:37:09
With the IRS, the IRS now directly will deal and they're currently furloughed. 00:37:14
But when they come back into business, like Miss Keene said, it could be 6 months, but it could be 3 years. You know, there's no 00:37:19
timeline of. 00:37:22
When this could be situated settled but. 00:37:26
With the law firm. 00:37:28
To my understanding, that's been. 00:37:30
Hired that you know they do deal with this. 00:37:32
With city government. 00:37:35
And the IRS will speak directly with them and it's. 00:37:36
Not common for the IRS to come and just want to. 00:37:39
You know, like Caesar. 00:37:42
You know, auction off a property that's government owned and they wouldn't just come. 00:37:44
And do it. 00:37:48
Yes, we do need to, you know. 00:37:49
Have clarity. 00:37:51
You know whose responsibility would be? 00:37:52
But uh. 00:37:54
You know, like. 00:37:55
Councilwoman Keene described. You know. 00:37:57
Is a shared debt. 00:37:59
Between the. 00:38:01
County, Kingsland, Saint Mary's, and I know Woodbine. 00:38:02
Is a mild contributor and has been, but you know they're pulling out of the PSA. 00:38:05
We do need to get clarification. 00:38:11
That you know. 00:38:13
Make a new agreement. 00:38:14
Of some sort. Maybe it's separate or. 00:38:15
An amended agreement that would outline worst case scenarios and that's what this would be the worst case scenarios if that were 00:38:17
to happen. 00:38:21
But it is something we have to deal with. 00:38:25
Either way, because it was, you know, funded by. 00:38:27
You know, the the local governments, the PSA, and yes, the PSA had its issues. 00:38:30
And and we're trying to, you know, obviously pull away from that. 00:38:35
As far as? 00:38:42
Not accepting the property. 00:38:43
We're almost in a position and there is no right answer here. 00:38:45
That there's not a direct right thing to do because it's a hairy situation, no matter which direction. 00:38:48
We choose to go. 00:38:53
You know the PSA. 00:38:55
Approve their budget, which is a significantly reduced budget for managing sports and only maintaining the property. 00:38:56
At 10:50 Wildcat Drive. 00:39:02
You know there is no. 00:39:05
Budget for any maintenance of any park. 00:39:06
You know so. 00:39:10
January 1, there's no. 00:39:11
Anything from the PSA. So it is, you know, going to be our responsibility, which we, you know, accounted for with these 00:39:13
discussions. 00:39:16
Robbie and I know that in 2019, were you in? 00:39:23
Your position 2019 perfect. 00:39:27
So there was a insurance settlement agreement. 00:39:30
That was roughly, we're going to use a rough number, about $600,000. 00:39:34
I know, just speaking with. 00:39:39
The chairman of the PSA board, who's on Kansas City Council. 00:39:41
You know, they got roughly $200,000, they set an account. 00:39:45
You know, so whenever a settlement would come that they. 00:39:49
Have that sitting there. 00:39:51
Do we know what we did with our share? 00:39:53
Of that insurance settlement. 00:39:55
It was it was a lawsuit by the county. 00:39:58
And it was distributed out and there was some monies there, so probably mid. 00:40:01
2019. 00:40:05
I think. 00:40:07
Right about that. So I'm curious what? 00:40:10
We chose to do with our. 00:40:12
Collection of that. 00:40:13
You know, if we by chance have set it aside, and if you don't know about it, maybe we have it. I don't know. 00:40:15
Don't know. 00:40:19
Finance, OK. 00:40:19
So I know they said there's a side, so. 00:40:22
But uh. 00:40:24
Neither here nor there. 00:40:26
You know we are going to have to. 00:40:28
Do something with the park. 00:40:29
As far as? 00:40:31
You know, it seems that we're gonna. 00:40:33
Take it over. 00:40:34
One way or another, that's what we want. We want to put money into it. We don't want to put projects on hold. 00:40:35
It is something we have to work out, but I don't know that terminating our existing. 00:40:41
Decision is the best thing to do, right? Well. 00:40:46
Hey, you know we've been. 00:40:48
Putting money into this park. 00:40:49
Which has been owned by the PSA. 00:40:52
Routinely. 00:40:55
We've been. 00:40:56
You know, repairing the water park. 00:40:57
And we are about to put some money into some tennis courts and. 00:41:01
I don't really see. 00:41:06
That that needs to stop. 00:41:07
I mean, I don't envision. 00:41:09
That this process of tapping the brakes on. 00:41:11
You know a. 00:41:15
Proving the transfer of the property. 00:41:16
Takes a very long time if in fact everybody is willing to pay their part. 00:41:19
When the time comes. 00:41:26
When we've negotiated something with the IRS, then it should be a pretty simple process to incorporate that into our agreement. 00:41:29
And I don't think it should take. 00:41:39
That long and in the meantime. 00:41:41
It doesn't hold us up. 00:41:44
I don't think that we should stop doing what we're doing with the parks. 00:41:45
Because we've been. 00:41:49
Doing some things with the park even though we don't own it. 00:41:51
I just think when you have a lien on a piece of property. 00:41:55
You want to have an agreement about how that lien is going to be paid before you accept the lien and the transfer because. 00:41:59
We've had already 2 failed offering compromises, we're working on another one. 00:42:08
The county. The PSA. 00:42:15
Is working on another one and they've got a very good firm working on it. 00:42:17
But the likelihood is that. 00:42:22
You know, we're not going to get an offer that reduces the whole liability. 00:42:25
And. 00:42:29
In the 2023. 00:42:31
Even though the liens add up to about $1.2 million in the 2023 audited financial statements for the PSA. 00:42:34
There's a footnote in there that says that the liability was 1.5 million. 00:42:42
So I don't. 00:42:48
Nobody really knows what the balance is right now, and that's another reason why I think. 00:42:51
We just need to. 00:42:57
Proceed with caution. 00:42:59
And that is my only reason for. 00:43:00
Bringing it. 00:43:02
To everybody's attention. 00:43:04
Mr. Blackerby, can I ask you that? That you? 00:43:06
Did you prepare the? 00:43:08
The Quitclaim. 00:43:10
Information for the City of Kingsland as well to take back the Lions Park. 00:43:12
I have not. 00:43:16
OK, because do they? I believe they have. 00:43:18
They have done that already as they were supposed to have done that. 00:43:21
Not I don't believe they have. 00:43:26
OK, you know one of the things that. 00:43:28
You know we have been talking about this property. 00:43:31
Since January. 00:43:34
And not knowing quite who owned what and. 00:43:37
There was a lot of debate about. 00:43:40
Did we own the land underneath the Aquatic Center or did the county own it all? You know, it was, there was a lot of back and 00:43:42
forth about it. 00:43:45
You know, the fact of the matter is, is that. 00:43:50
You know this property and any property that. 00:43:52
I would assume. 00:43:55
I don't know why it would just have been placed on. 00:43:56
One piece of property. 00:43:59
But if the IRS had a lien on. 00:44:01
On properties. 00:44:04
Owned by the PSA. Then it would have been all the properties owned by the PSA. 00:44:08
Presumably. Is that a fair assumption or would they? 00:44:12
Question that I've. 00:44:16
That I have is which properties were actually conveyed to PSA because talking to the PSA attorney. 00:44:17
He indicated that there were a fair number. 00:44:22
That had been. 00:44:24
Intended to be conveyed that there were. 00:44:25
I think in particular there's a parking wood behind that never got conveyed to PSA so that still owned by Woodbine. 00:44:29
And then I'm not sure about some of the county. 00:44:34
Parks either. 00:44:36
OK. So would it be accurate that the lien would be? 00:44:37
Also attached a 1050 Watt cap drive where the PSA. 00:44:40
Offices and and Lions Club parking. He's actually owned by the PSA. So if you look on the public records, I was. 00:44:44
Let me finish please. 00:44:52
So the. 00:44:54
You know the lane's going to exist whether. 00:44:56
We own it. 00:44:59
Or expect the PSA owns it. 00:45:00
And uh. 00:45:02
The possibility of the property being seized. 00:45:03
And sold at auction or whatever in order to satisfy this. 00:45:06
And this amount due to the IRS. 00:45:10
Is a possibility either way. 00:45:13
And you know that that was just kind of the reality I thought we were dealing with. 00:45:16
And I know some of the steps that the PSA has been taking with. 00:45:20
As Council. 00:45:23
Member Keen mentioned. 00:45:25
That they had filed to have this dismissed in two prior occasions. 00:45:26
But when they had done that, they had not done all of their quarterly filings and so it was an incomplete record. 00:45:30
And so they were summarily just. 00:45:35
You know. 00:45:38
Ignored because they had not had a complete tax record yet. 00:45:40
So in recent months. 00:45:44
That complete record has now been filed with IRS. 00:45:45
And the PSA is. 00:45:49
Currently. 00:45:50
Has done everything that the IRS. 00:45:52
Has asked of them. 00:45:55
In order to. 00:45:57
Move this process forward. 00:45:58
And so. 00:46:00
As those are now being documented as being filed by the Rs. 00:46:01
The tax firm. 00:46:05
That the PSA is hired. 00:46:07
Is going to be, you know. 00:46:09
Seeking for some dismissal of some of the fees. 00:46:11
Interest. 00:46:14
Or actually partial fees. We don't know what will happen there. 00:46:15
But my other contention was is that you know. 00:46:19
This uh. 00:46:21
Even though there's no language specifically to it in the that I could find or. 00:46:23
And that we've reviewed yet that. 00:46:27
Indicates that. 00:46:30
Specific debt of the PSA is. 00:46:33
Would be shared by everyone that's part of the PSA. 00:46:36
You know, in all my conversations with. 00:46:41
Leaders from the other cities and PSA. 00:46:43
That. 00:46:46
It is, you know, clearly understood that this debt is. 00:46:48
Belongs to the PSA and thus. 00:46:51
Belongs to everyone. 00:46:52
And. 00:46:54
You know, and speaking with Mr. Blackaby today. 00:46:56
In the new IGA that you know. 00:46:59
That we enter into my question really kind of was, does this belong in the IGA even? 00:47:01
Because. 00:47:06
If Woodbine. 00:47:07
Who had voted previously not to. 00:47:09
Join the new IGA. 00:47:11
They would still. 00:47:14
Would not they still be liable for their share? 00:47:15
Of this debt, you know, umm. 00:47:19
And I think we would all agree. 00:47:21
And a moral standpoint that. 00:47:23
Yes they would. I mean they were part and parcel. 00:47:25
To this when it occurred, you know, 15 years ago. 00:47:27
And under that. 00:47:30
IGA. 00:47:32
But as as Council. 00:47:34
You know, King pointed out. We. 00:47:36
You know, people are people and people in money, they do things. And so, you know, I don't think it's a bad idea to. 00:47:38
To have a written agreement that. 00:47:44
Specifies. 00:47:47
And everyone I've spoken to would kind of agrees to this or. 00:47:49
Kind of, but does agree to the. 00:47:53
Fact that it is shared debt. 00:47:55
It belongs to all of the municipalities and county equally. 00:47:57
Are not equally but based on their proportional share. 00:48:01
Of this debt. 00:48:05
And so. 00:48:06
If we can add that into the new agreement. 00:48:07
If Woodbine does choose to join this initial agreement. 00:48:09
If they don't, then I think we have to have an agreement outside of the IGA. 00:48:13
That addresses this debt if we're trying to get something in writing. 00:48:17
But. 00:48:22
You know the cities and the counties we have. 00:48:24
They were 20 years ago. I don't know how many of you were here, but. 00:48:27
There were a lot. There used to be a lot of back and forth. 00:48:31
There was a lot of negative negativeism. 00:48:34
Between. 00:48:36
The municipalities in the county and and. 00:48:37
Nasty working relationships and things didn't go well that. 00:48:40
You know that is much improved in these years and everyone has good work and relationships. 00:48:44
And uh. 00:48:49
You know, naive as I may be, I do trust the relationships of. 00:48:50
Of the other leaders that we have that. 00:48:55
That we can settle this. 00:48:58
And so for that reason, I didn't necessarily personally think that it was. 00:49:00
Necessary to step backwards. 00:49:04
From the progress we're made into getting this property in our name. 00:49:05
Because that lien is going to exist. 00:49:09
Whether it's in our name or it's. 00:49:11
You know, back at the PSA. 00:49:13
And if the IRS wants to seize the land? 00:49:16
They're going to seize it, we're going to lose it either way. 00:49:18
If that's what happens. 00:49:21
And you know, there's there's no negotiating tactic. 00:49:23
For leverage that. 00:49:28
Putting that land back in the PSA. 00:49:30
And away from us. 00:49:32
Is going to protect that land. 00:49:34
You know if. 00:49:36
If. 00:49:37
We don't have the. 00:49:38
Buy in from the other partners. 00:49:39
And so I don't really see that the land as being a. 00:49:42
Negotiating leveraging tool. 00:49:45
To us coming up with. 00:49:47
A plan. 00:49:51
A legal plan that says. 00:49:52
We will all. 00:49:54
A share in the liability. 00:49:55
In in a in a legal document, because it's not built into the current IGA, it's not built into the. 00:49:58
Previous IGA and so we do need some sort of document. 00:50:04
To that end. 00:50:07
I didn't think that in the way of moving forward. 00:50:08
With our recreational plans and the things that we want to do with the part. 00:50:12
Maintaining and in. 00:50:16
Proving the parks. 00:50:17
That we made this step. 00:50:19
And if the county has not signed? 00:50:20
The deed for this and it actually. 00:50:24
Completed the transaction. 00:50:26
I believe they would be willing to. 00:50:29
Tap the brakes as you said, and hold off on that if we ask them to. 00:50:31
No rush necessarily doesn't do anything for them one way or the other. 00:50:35
But I believe we can move forward and and get the relationship the. 00:50:40
The agreement that we need. 00:50:45
You know to put in. 00:50:47
And in the legal terms? 00:50:48
How this liability will be? 00:50:51
Taken care of. 00:50:54
And and that was just kind of my. 00:50:55
My state, I agree with you 100%, you know. But I believe in putting it in writing. 00:50:57
You know I trust them. 00:51:02
And everything too, but. 00:51:04
We probably need to. 00:51:06
Change the. 00:51:09
Warning in the IGA to. 00:51:10
100% agree, but I just I don't see that. 00:51:12
Transferring the land back and forth. 00:51:15
You know, really you know, face. 00:51:16
We can, we can, we can continue to go. 00:51:18
The route that we're going, you know it's not going to. 00:51:22
Pay the bills IRS IRS is still going to be. 00:51:24
A problem. 00:51:28
But what I wanted to do was to make sure that the county. 00:51:29
And the cities. 00:51:33
Have a shared interest in. 00:51:35
What's going to be paid back? 00:51:37
That's all. 00:51:39
Yes, Sir. 00:51:41
I'd like to make a motion to. 00:51:47
Not rescind our resolution. 00:51:49
So I don't know if that's. 00:51:53
Going to do that in that order or? 00:51:55
Make a motion to add it to the. 00:51:57
Well, I think the agenda item. 00:51:58
Was framed as. 00:52:01
It's going to be a motion to rescind it, so I think. 00:52:03
You could just take no action if I just take no action for now and we could reconvene at a different meeting if needed on this, 00:52:06
but I do think we need to. I guess the proper thing would be to ask if there is a motion. 00:52:12
To rescind. 00:52:18
I'd like to make a motion. 00:52:23
That we rescind the resolution and quick claim deed for transfer of ownership regarding Saint Mary Civic. 00:52:25
Art and Lake Saint Mary's Camden County Public Service Authority. 00:52:31
OK. Is there a second? 00:52:39
2nd. 00:52:41
OK, so is there any other discussion? 00:52:42
I'd like to ask Mr. Blackerby if he. 00:52:46
Will advise us. 00:52:49
Unless since he knows a lot more about this. 00:52:51
Then we do. 00:52:54
One thing that I totally agree with is there's there's not a right or wrong answer here. 00:52:57
There are several ways it could play out with the lean. 00:53:02
Being in place, I mean. 00:53:06
Hopefully. 00:53:08
The PSA. 00:53:11
Stays around for a long time and it's fully funded and pays off the lien. 00:53:11
And that's hopefully what happens. And I would assume that's the most likely outcome. 00:53:15
If you take. 00:53:20
Take the transfer of the ownership. 00:53:21
And for whatever reason, the PSA. 00:53:23
Isn't fully funded in the future to pay that lien off. 00:53:25
Then we're holding the property subject to it, to the lien that is. 00:53:29
And you could have a situation. 00:53:33
Maybe very unlikely, but you could have a situation where the IRS comes looking to get paid and says we're going to levy on that 00:53:36
property. 00:53:38
And chooses that one to be the target of their levy. 00:53:41
On the flip side, if you. 00:53:47
If you leave it in the ownership of the PSA. 00:53:49
And the PSA. 00:53:53
Doesn't have funding to continue paying it then. 00:53:54
You're still not in a good situation because then you've got a PSA board that you've only got 2 members on. 00:53:58
And. 00:54:02
They could decide. 00:54:03
You know what, we don't have the money to pay the IRS. We're just going to give them the property. 00:54:04
In lieu of paying it. 00:54:08
That's a possibility as well. 00:54:09
So. 00:54:11
There are multiple bad outcomes and there's hopefully a good outcome that. 00:54:12
That's going to happen, which is that the PSA remains funded and pays this off, but. 00:54:17
It's it's really a matter of your comfort level, I guess, in terms of how to move forward and your relationship with the other 00:54:22
cities. 00:54:25
And the county? 00:54:29
I do think it's imperative and and. 00:54:30
This has been said multiple times. We do need to address this in the intergovernmental agreement going forward and we need to 00:54:33
include a provision. 00:54:36
That clearly provides that the. 00:54:39
The liabilities. 00:54:40
And the debts of PSA. 00:54:41
Are jointly shared. 00:54:43
In, in, in accordance with the percentages by which we're funding the PSA. 00:54:44
And that that is an obligation that will survive the intergovernmental agreement. 00:54:48
Because right now we don't have that in place, right? And we do not have it. 00:54:53
And in our art. 00:54:56
Intergovernmental agreement has expired. Is that correct? That is correct, but even if we had it, it wouldn't. 00:54:58
Speak specifically to us, because even under that intergovernmental agreement, any city or the county. 00:55:04
Could withdraw upon 90 days notice and it stated that the funding obligation ceased upon that 90th day. 00:55:09
So that's got to be addressed. And and we're already, we're already trying to to, you know, hammer out a new government agreement 00:55:16
and still trying to figure out how Woodbine will fit into that. 00:55:21
If at all. 00:55:26
But while. 00:55:27
While we're working on that, I think we need to address this as well in the new intergovernmental. 00:55:29
I would like to change my. 00:55:34
Motion. 00:55:36
Let me withdraw the motion that I just made. 00:55:37
And change it. 00:55:42
To based on. 00:55:43
The advice that we've had. 00:55:47
That we. 00:55:49
We can vote on rescinding. 00:55:51
But I think that. 00:55:54
Hold on a second, because we do have a motion on the floor, we have to vote on it. 00:55:55
OK, I'd like to withdraw my motion. 00:56:01
2nd. 00:56:04
I always draw my second. 00:56:05
OK, so. 00:56:08
Original motion has been. 00:56:09
Withdrawn and seconded, and we need to vote on that withdrawal. 00:56:11
Or, or is it just strong OK? 00:56:15
And the reason I'm doing that? 00:56:18
Is the risk. 00:56:21
Of not owning the property. 00:56:22
And the ultimate need for the IRS to. 00:56:26
Seize it and us not having control of the park. 00:56:32
But I am. 00:56:37
I think that this was a discussion that we should have had. 00:56:40
And the Council should have been. 00:56:43
And formed all council members. 00:56:46
That there was. 00:56:49
Excuse me, in fact. 00:56:52
A very large lien on the property before we were asked to vote. 00:56:54
On whether or not to transfer it. So I think the discussion has been fruitful. 00:56:59
And that respect and I appreciate everybody's. 00:57:04
Thoughts on it? 00:57:07
So we're back to. 00:57:11
I don't know if that was a new motion or if we just comment there is no motion. 00:57:13
So OK. 00:57:18
Yeah, so for lack of emotion and 2nd the. 00:57:21
Item I. 00:57:25
Fails. 00:57:26
Oh, no action. 00:57:27
There was no motion, she. 00:57:30
Lack of motion. 00:57:32
OK. Announcement of our calendar. 00:57:35
Yes, Sir. 00:57:39
On Wednesday, October the 8th. 00:57:40
There is, Bobby. Are you still having a? 00:57:43

Still having it OK. 00:57:49
There will be a pre bed. 00:57:50
Or Saint Mary's Rd. intersection improvement project. 00:57:52

On that day is at 4:30 Jamie. 00:58:35
4:30 work session on that day. 00:58:37

Also sent out today by the by. 00:59:09
Finance director will be a 5:00 PM. 00:59:11
Public hearing on the mileage rate followed by the 6:00 PM City Council meeting. 00:59:14
Thank you, Sir. 00:59:19
Come here. All right, Councilmember, comments. 00:59:20
I I just want to. 00:59:28
I didn't get a chance to talk to my. 00:59:29
Cousin back there with all that Steeler. 00:59:32
Gear on, but the Jaguars will be playing tonight at 8:00, so. 00:59:34
You need to go home and put on your teal. 00:59:40
We won't be having another meeting before then so. 00:59:48
You know our. 00:59:51
1st Friday has been rebranded to a live after 5. 00:59:52
You know, and it's not first Friday anymore because it might not be on the 1st Friday, which is the case this month. 00:59:56
So in an effort not to compete against other local activities, especially Wildcat football. 01:00:02
They're able to make this event flexible and move the dates and it's been a. 01:00:07
A great event. They've actually enhanced it. I think we're on about our fifth month, our fifth month, I believe, or 6:00 somewhere 01:00:11
in there where we've had increased vendor activity, music, live music, bands. 01:00:17
It's just a good time. There's kids activities, so. 01:00:22
If you haven't made one, please do check it out. It'll be October 17th this month. It'll be the 17th. We're Alive After 5 starts 01:00:25
at 5:00 PM. 01:00:29
I heard nothing but good things about it. 01:00:33
Check it out. Come on. 01:00:35
I've been there, but I mean. 01:00:37
Everybody's talking goodbye. 01:00:38
Yes, I'd like to thank. 01:00:43
The city staff. 01:00:46
Volunteers and the clients for the Seafood Festival. 01:00:48
And St. Mary's. 01:00:52
It was. 01:00:54
Very, very well received. 01:00:56
And I know the rock shrimp was well received. 01:00:58
And uh. 01:01:02
I was. 01:01:03
Wow, pleasant. 01:01:04
Treat heaven rocks from back. 01:01:06
For the first time in over 10 years, so. 01:01:08
Thanks, Angela. 01:01:13
Anyone else? 01:01:16
OK. 01:01:19
And I'll just echo. 01:01:20
Mr. Rasi, sentiments about the city staff and. 01:01:23
You know it it and the Colonians it takes, it takes a lot of people to put on these festivals and. 01:01:27
Lot of hard work, they go behind the scenes from everyone and. 01:01:32
Even though the day started out a little shaky with some rain, we ended up with a beautiful day and. 01:01:37
It was a great festival and I hope you had time to. 01:01:42
Come down and check it out and if not. 01:01:45
1st Saturday in October next year, you know we'll be right back here again for that so. 01:01:47
Please join us. 01:01:52
Yes, ma'am, I do apologize. The Scarecrow stroll. Angela, did you want to announce that the date of the Scarecrow stroll? 01:01:54
Yeah. 01:02:02

Two things. 00:13:43
The item. 00:13:44

10:00 AM. 00:57:46
Or is that the one you moved? 00:57:47
Still having it OK. 00:57:49
There will be a pre bed. 00:57:50
Or Saint Mary's Rd. intersection improvement project. 00:57:52
Esplanade Blvd. here in council chambers and again, that's. 00:57:55
10 AM on Wednesday, October. 00:57:57
The 8th and there's some development authority. St. Mary's has moved their meeting. 00:58:00
To October to 8th at 5:00 PM. 00:58:04
In the Main Street office on Thursday, October the 9th. 00:58:07
In the Main Street office at 9:30, we'll have the Orange Hall Management Committee meeting. 00:58:10
Again, that would be a Main St. followed by the 5:00 PM Saint Mary's Intercoastal Gateway meeting. 00:58:14
And Main St. as well. 00:58:20
And on Monday, October the 13th at 8:30 AM in Main Street, the Downtown Development Authority meeting. 00:58:21
On Tuesday, October, the four. 00:58:27
There's a 5:30 PM Planning Commission meeting and also the Planning Commission. 00:58:29
Has added a work session. 00:58:33
On that day is at 4:30 Jamie. 00:58:35
4:30 work session on that day. 00:58:37
On Thursday, October the 16th. 00:58:39
Tonight, which will be which has already been sent by our Finance Director. 00:58:42
That will be the first two of the public hearings on the tax increase regarding the mileage rates. 00:58:46
Again, that will be Thursday, October the 16th. 00:58:51

And on Monday, October the 20th. 00:59:07
